Driving under the influence is considered a criminal offense. If you're convicted of a DUI or DWI it will end up on your driving record. Field sobriety testing

The National Highway Traffic and Safety Administration (NHTSA) guidelines were set up to help make these sobriety tests 'standardized' for better accuracy. The officer must correctly perform the field sobriety test. The U.S. Department of Transportation explains the Field Sobriety Test as a battery of three tests administered in a standardized manner to obtain validation of impairment and establish probable cause for arrest.


If you're over the limit, you will be arrested for a DUI and taken to the police station to be booked and held in jail. Note that you may be arrested with or without the police having to prove impairment if they feel you're exhibiting drunk behavior. Personal property, such as keys and cash, are also confiscated at this time and returned upon release unless they're needed for evidence in the case against you.

In the process of a DUI case you may be allowed to post bail immediately or be released on your own recognizance, which means you exchange your release from jail for a signed promise to appear in court to decide the case. In other situations, you will be required to wait in jail for a hearing before a judge to determine the amount of bail. Either way after bail is posted you will be released from jail with the promise to return for a court hearing at a later date.

Driving under the influence (DUI) or driving while intoxicated (DWI) is defined as the act of driving a motor vehicle with blood levels of alcohol in excess of the legal limit.
